Fake Lottery Winner:

It has been reported to WPMLS that several Participants have been contacted by a bogus prospective purchaser who claims to have won the lottery. The individual has no private means of transportation so the agent has to pick her up, and she insists that she wants to close quickly. It has also been reported that this individual has written bad checks. |

WPMLS continues to receive reports about a certain property in Yonkers where the owner behaves indecently in clothing and manner when female Realtors visit the property. PLEASE NOTE THAT THIS PROPERTY IS NOT LISTED IN MLS. The owner requests an agent to come ot the property to do a listing presentation. Yonkers police won’t do anything about it unless the complainant is present. WPMLS recommends, therefore, if you encounter this circumstance, leave the premises, but stay in the area, call Yonkers police, and assist them when they arrive. |

Attached/Detached Means Properties, Not Garages

The "Attach/Detach" field refers to whether the house is attached or detached to another house, not whether there's a garage that is attached or detached. To convey information about the garage (if any), go to the "Parking" field where there are various choices (including attached/detached garages) for explaining how the parking is accommodated.
Some buyers and cooperating brokers want attached housing, and so the listing agent has to make the correct entry in order for the property to show up (or not) in searches that rely on the Attached/Detached status of the property. Please take care.

It is with great sadness that we announce the passing of Jo Ventura, ABR and associate Broker, of the Prudential Serls Prime Properties Brewster Office, after battling stage 4 cancer for the last 18 months. Jo had quite a zest for life and excelled in everything she did. She was an accomplished real estate agent in Dutchess, Putnam and Westchester. She always put her clients first. She will be missed dearly by her family, friends and collegues.

Anita C.Trainor, a long-time resident of Pelham Manor, passed away on Sunday, Feb. 24, 2008.
Anita, a highly successful licensed Real Estate Associate Broker and WCBR, Inc. member for many years, will fondly be remembered for her love of swimming, travel, foreign languages, the beach and her devotion to her family.
A funeral mass will be held at 11:15 AM Thursday at Our Lady of Perpetual Help Church in Pelham Manor.

She was eighty three years old and had retired from real estate just three years ago. She moved last year to Chicago, Il, when her health began to fail, to be with her surviving daughter Anja. |

WPMLS understands that some questions have been raised in connection with our announcement of the Zone reconfiguration. Here’s the straight information:
1) Do agents have to get brand new listing agreements from their sellers? No. All we’re asking you to do is report to WPMLS the ones you already have. The Rapattoni MLS system will see these as late listings but from December 17-26 we are turning off the MLS software that generates fines for late listings. Please report your listings in that designated time period to avoid computer-generated fines. We’re also waiving the $5 listing entry fee. Once you’ve entered the listing you should fax the listing agreement the same way you normally do. For step by step instructions, CLICK HERE.
2) Does WPMLS recognize and accept listing agreements other than its own model listing agreements (such as Mid-Hudson MLS listing agreements)? Yes. All we care about is that your listing agreements comply with the basics of New York State license law.
3) Do out-of-area agents have to join WPMLS? No. There’s no change from the current policy. If you want to access WPMLS with your own name and code, there’s an annual charge ($40 in 2008); if you want to operate through your principal broker instead, the broker pays MLS fees but you don’t.

On Tuesday, November 27th you will receive an email from NAR’s REALTOR Action Center asking you to email a letter to Senators Schumer and Clinton in support of modernizing the FHA loan programs and allowing regional adjustments to Fannie Mae and Freddie Mac loan limits. It’s easy to do these letters – just follow the simple steps outlined in the NAR email.

Admittedly, these programs don’t get a lot of use in Westchester on account of our high prices. However, that’s what the legislation is partly about. So, when you get the “Call to Action” on Tuesday, please do take a minute to respond because it will be good for the entire real estate industry to get this legislation passed.

The Department of Justice has issued an advisory concerning fraudulent spam e-mail messages claiming to be from DOJ. The fraudulent messages are addressed “Dear Citizen.” The messages assert that the recipients or their businesses have been the subject of complaints filed with DOJ and also forwarded to the Internal Revenue Service. A DOJ logo may appear at the top of the email message or in an attached file. Finally, the message may include an attachment that supposedly contains a copy of the complaint and contact information. THESE EMAIL MESSAGES ARE A HOAX. DO NOT RESPOND. For more information click here. |
Sentricard Invoices

Important! If you have not paid your SentriCard invoice the card is now inactive. Make sure you renew before going to a property with a lockbox. Staff has to re-enable the card after you’ve paid (there’s no weekend service), so make sure you pay early in the week. Sentricard invoices are available online at http://ims.wcbr.net. This invoice will only appear on your account if you currently have an active Sentricard for the SentiLock system. The period for discounted renewal is closed and renewals are now $90 whether paid by check or on-line. If members do not currently have a card but would like to obtain one, please contact Emily Boseman at the WPMLS offices, 681-0833.

For a listing to be eligible for submission to the WPMLS, there must be some offer of compensation to cooperating agents and there can be no expectation on the part of listing office that the cooperating agent will collect compensation from the tenant and share that compensation with the listing agent.
Please review the following rules and regulations:
Section 7:4 Percentage Rate of Commission on Every Listing:
[A] THE RATE OR AMOUNT OF COMMISSION CHARGED FOR THE SALE, LEASE,
APPRAISAL OR MANAGEMENT OF REAL ESTATE SHALL BE NEGOTIATED
BETWEEN EACH PARTICIPANT AND HIS CLIENT.
Every listing contract filed with the Service shall include either:
[I] the percentage of the purchase price which the Selling Participant shall
be entitled to receive upon the sale of the property; or
[ii] the amount of compensation the Selling Participant shall be entitled to
receive for services rendered in connection with the consummation of
the sale.
NOTE 1: In filing a property with the Multiple Listing Service of a
Board of REALTORS, the Participant of the Service is making blanket
unilateral offers of compensation to the other MLS Participants, and
shall therefore specify on each listing filed with the Service, the
compensation being offered to the other MLS Participants. Specifying
the compensation on each listing is necessary, because the
cooperating broker has the right to know what his compensation shall
be prior to his endeavor to sell. |

WPMLS has received numerous complaints about abuses in the broker open house notice. Agents are listing open houses, and then indicating they are postponed or cancelled. Or an open house is listed with the caveat that property is on a lockbox, please check it out. The open house function is for alerting participants about actual open houses. It is not an advertising vehicle. Let's please all treat each other like professionals and not post 'phony' open house messages. If asking for cooperation doesn't work, WPMLS will impose fines for what are basically listing misrepresentations. |

You can avoid one particular type of fine by taking a moment to learn the ENTIRE listing entry procedure. Here’s what it’s about:
You must submit a copy of the listing agreement to WPMLS within 24 hours of execution. There is a $15 fine for failing to do so. Watch the security in your office! WPMLS has received recent reports from two offices that two women, posing as customers, visited the offices. One used the restroom and, according to reports, helped herself to purses and other loose valuables along the way. It’s never a good idea to leave valuables out in the open. |

WCBR and its Westchester REALTOR® Foundation are gearing up for our biennial "Hope for the Homeless" fundraiser where we show that REALTORS® truly care about homelessness in this area.
Save the evening of Wednesday, October 22 for a truly exhilarating program that will be very different from anything the Board has ever done. (It involves race carts, and that’s all we’re telling you for now!) In the meantime, though, our Hope for the Homeless Committee chaired by Gail Fattizzi of Westchester Real Estate, Inc. (gmfbhg@aol.com, 914-961-5510) needs volunteers who are willing to help out with the silent auction, program journal, sponsorships, ticket sales, and other details that make for successful events. We’ve hired a professional meeting planning firm to keep the job from getting out of hand, but we still need YOUR help for that Realtor spirit touch. WCBR Realtor Jeannette Wang is the President of the Organization of Chinese Americans – Westchester Hudson Valley Chapter (OCA-WHV) serving Chinese and Asian Pacific Americans generally. OCA-WHV, a 501(c)3 not-for-profit organization, has set up an account with HSBC to funnel contributions to the relief effort through the Chinese Red Cross and other contacts.
If you would like to contribute:
1) Make check payable to “OCA-WHV”;
2) Notate the check to “Earthquake Relief” and specify either “China” or “Myanmar”.

WPMLS regrets to report the passing of longtime Pleasantville resident Dorothy Rosenberg who died May 5, 2008 in Sacramento Calif. She was born in 1923 in Mt. Vernon, NY and moved to Pleasantville in 1950. A memorial service will be held at Beecher’s Funeral Home, 418 Bedford Rd., Pleasantville, NY at noon, Friday May 9, 2008. She was a dedicated and active member of the community and served on the Pleasantville Fund for Learning; the Community Scholarship Fund; Friends of the Mt. Pleasant Library; the Chamber of Commerce; Pleasantville Rotary and as president of the Roselle Ave. School PTA. She was a long-time member of Temple Beth-El of No. Westchester and was active in the interfaith council and a former membership chair.
In 1964, Dorothy opened Clark’s Corners Gift Shop on Wheeler Ave. in Pleasantville which she operated for 18 years before starting a new career in real estate. She was an award-winning sales associate working for Bixler, Coldwell Banker, and Holmes & Kennedy until her retirement in 2000. She then moved to California to be closer to her children.
Suggested memorial donations may be sent to the Pleasantville Fund for Learning, the Pleasantville Community Scholarship Fund, Friends of the Mt. Pleasant Library and the Alzheimers Association.

We regret to report that Realtor Daniel Sadofsky, principal of Toddville Real Estate, Corltandt Manor, passed away on Sunday, April 20. He was at one time an active member of WCBR's Legislation Committee. There is visitation tomorrow, 4/22 from 11 a.m- noon. Rotary commemoration will be at 11:45, followed by a funeral service at noon at E.O. Curry Funeral Home, 313 N. James St. Peekskill. Click here for directions. An unfortunate incident was reported to WPMLS by a Participant this morning. A property owner in the Yonkers area scheduled an appointment with a Participant to visit his home for a pre-listing evaluation. Upon arriving at the home the Participant found a note on the door advising the agent that the homeowner was in the shower and she should let herself in. The agent did not enter the property but continued to knock on the door. The property owner asked her to enter the property and, upon entering, the homeowner acted provocatively and in an inappropriate fashion. Bill Happas – Loving husband, nurturing father, dear friend, great Realtor and funny comic – passed away Wednesday, February 27 way before his time. Bill started his second career as a real estate agent approximately 7 years ago and quickly rose to the ranks of top producer. Bill also moonlighted as a comic whenever and wherever there was an audience who would actually listen to him! Bill was truly loved by all whose life he touched and he will be sorely missed. Bill’s calendar was always full with either helping clients, being a friend, or loving his family and everything this man did he did with a very strong joie de vivre. A long time resident of Larchmont, he recently moved to New Rochelle to enjoy a wonderful and relaxed lakeside life with his Wife, Diane, and their daughter, Leslie, who has since moved into New York City.
Friends and family will be gathering Saturday and Sunday March 1st and 2nd, from 2-4 and 7-9 at Fox Funeral home on Boston Post Road in Larchmont, and there will be a Christian Mass at 10am at Saints John and Paul on Weaver Street in Larchmont on Monday, March 3rd .

Clayton William Schwartz, son of Marilyn Schwartz of Teamweavers, and resident of Nashville, TN, and former resident of Katonah, NY, passed on Sunday February 24th. He was born on September 20, 1975, and is gone from us too soon.
In May of 2006, Clayton was paralyzed in a motorcycle accident. He lived in strength and courage till the end.
Clayton graduated from John Jay High School and SUNY Potsdam College. He was attending Vanderbilt Law School in Nashville, TN. Clayton embraced life with vigor, and prior to his accident he was a yoga aficionado, worked the Alaskan fishing boat circuit and enjoyed adventure riding on his motorcycle.
A memorial mass will be held in his memory at St. Mary’s Church, Route 302, Bethel, CT, 203-744-5777, Friday February 29th at 10 AM.

Please telephone WCBR on Friday morning at 914-681-0833 to see if the 10 a.m. Board of Directors meeting is cancelled on account of snow. There should be a message at our switchboard no later than 8:45 a.m.
We can’t make the decision today (Thursday) or even tonight because there is just too much unpredictability in the forecast. It is our intention to have the meeting unless driving conditions become tricky. But in the event of a cancellation, we are rescheduling to Monday, Feb. 25th, 10:00 a.m., and this will be confirmed in the telephone message.
PS Executive Committee: We will try to phone you on your cell phone earlier on Friday to advise if the Executive Committee meeting is still on or is postponed.

It is with deep sadness that WPMLS reports the passing of Marie Brehm, principal broker of Century 21 Village and Country in Croton-on-Hudson, New York. Marie was a member of WCBR since 1974 and she served on the WCBR Board of Directors on numerous occasions.
A wake will be held from 2PM to 4PM and 7PM to 9PM on Thursday, January 24th, at the Edward F. Carter Funeral Home located at 41 Grand Street in Croton-on-Hudson. A funeral mass will be conducted on Friday, January 25th, at 10 AM at the Holy Name of Mary Church in Croton-on-Hudson followed by her burial at the Bethel Cemetery.
